3. Terms and Conditions Please read these Terms and Conditions ("Terms") carefully before using the Webqonic website and services ("Service") operated by Webqonic Tech ("us," "we," or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. 1. You are responsible for safeguarding your account credentials. Acceptable Use: You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. WhatsApp Business Platform Policies Our Service is a tool that allows you to access the WhatsApp Business Platform. Your use of our Service is strictly subject to your compliance with all applicable Meta policies, including but not limited to the WhatsApp Business Messaging Policy and WhatsApp Commerce Policy. You acknowledge and agree that Webqonic has no control over Meta's policies or enforcement actions. We are not responsible if your WhatsApp account is banned, suspended, or restricted by Meta due to your violation of their policies. You are solely responsible for the content of the messages you send and for ensuring your campaigns comply with all applicable laws and regulations. 3. Payment and Fees Fees: You agree to pay all fees associated with your chosen plan in accordance with the pricing and payment terms presented to you at the time of purchase. Fees are non-refundable except as expressly provided in our Cancellation and Refund Policy. Billing: Subscription fees will be billed automatically at the start of each billing cycle. You authorize us to charge your chosen payment method for these fees. 4. Intellectual Property The Service and its original content (excluding Client Data), features, and functionality are and will remain the exclusive property of Webqonic and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Webqonic. If you purchase Source Code, your rights to use, modify, and distribute that code are governed by a separate license agreement provided at the time of purchase. 5. Disclaimer of Warranties THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WEBQONIC TECH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK. 6. Limitation of Liability IN NO EVENT SHALL WEBQONIC TECH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. 7. Indemnification You agree to defend, indemnify, and hold harmless WEBQONIC TECHand its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms, or c) your violation of any Meta/WhatsApp policy. 8. Changes We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. 9.
